Productpriceguarantee period– theenddateofthe time period until which the Seller has guaranteed not to change the prices of the Goods if the Order is paid for within this time period
Cancellation form– a form that can be filled out to exercise the right of withdrawal.

Courier− A cooperationpartner selected by the Seller who delivers the Goods paid for by theBuyeronbehalfoftheSeller.

1. General provisions

   1.1. The Buyer orders, and the Seller undertakes to deliver, the goods that are availableonthewebsite.www.biowitel.com, hereinafterinthe text of the contract – the Goods, the names, packaging, prices, quantity and value of which are agreed upon when the Customer places an Order and are indicated on the invoice. 1.2. 1.3. The Buyer undertakes to order and accept the Goods and pay for them the Order price in accordance with the procedure specified in the Agreement. 2. Registration and processing of personal data

2.1.The Seller undertakes to observe confidentiality and guarantees the security and use of personal data in accordance with the requirements of the Personal Data Protection Law and the Information Society Services Law. Information may be provided to third parties only in the cases and in accordance with the procedure provided for in the legislation of the Republic of Latvia. 2.2. The Seller undertakes to process the personal data referred to in this Agreement, to store them only for the intended purpose and to the extent necessary for this, including for improving the service, sending advertising materials. The Seller is entitled to transfer the Buyer's personal data to cooperation partners and data processing companies working for the Seller. The collected information may be used for strategic and marketing purposes. 2.3. The buyer is responsible for the accuracy of the data specified during registration, as well as for theuserregistrationdata, www.biowitel.com foractionstakeninthe online store and consequences resulting from the provision of false information, including, but not limited to, indicating an incorrect delivery address or mobile phone number. 2.7. The Buyer is responsible for maintaining all data specified during registration in complete security, and the Seller is not liable for losses caused to the Buyer if the Buyer has carelessly maintained the registration data, as a result of which they have come into the possession of third parties and have been misused. 2.8. The Buyer is obliged to immediately notify the Seller of possible manipulations of the Buyer's registration data by third parties, as well as in cases where the Buyer suspects that his registration data has come into the possession of third parties. 2.9. The Seller has the right to block the Buyer's access to the online store if it seems to him that third parties are acting maliciously on behalf of the Buyer. The Seller shall inform the Buyer about the blocking of access. 2.10. The Buyer, who is an Unregistered Buyer, when placing an Order intheonline store www.biowitel.com andbyprovidingtherequestedinformation, agrees to the Terms and the processing of personal data provided to the extent necessary for the proper execution of the purchase of Goods, namely: 2.10.1. For informing Buyers, for the sale and delivery of Goods, for Buyer identification – Name, Surname, Mobile phone number, E-mail, City / Village, Street / house name, House No. / building, Apartment No., Postal code. 2.11. A registered Buyer has the right at any time to clarify, change, supplement the previously provided data or delete his registration intheonline store www.biowitel.com. 2.12.  3. Product prices

4. Availability of goods

    4.1. If any of the Products is not available at the time of dispatch of the Order, you will be refunded the value paid for the Product. 4.2. If, before dispatch of the Products, it is determined that any Product is in insufficient quantity, then the insufficient Product will be provided to those Buyers who first placed the Order. Buyers to whom the Product cannot be delivered will be refunded the value paid for the Product.

 5. Order processing

 5.1. The Order is placed by clicking the “BUY” button in the “My Cart” section. The Buyer is obliged to follow the steps of the Goods purchase process, filling in and checking the information requested at each step, as well as making sure that the goods placed in the cart are correct and in quantity. 5.2. By clicking the “BUY” button, the Buyer is offered the opportunity to Authorize – enter the Registered Buyer’s profile and complete the purchase or make the selected Goods purchase as an Unregistered Buyer by specifying all the necessary information. 5.3. If the Registered Buyer has already entered his/her profile, then the information necessary for making the Goods purchase must be supplemented with the missing information. 5.4. During the order processing process, the delivery method must be selected. 5.5. 6. Order payment

If the Buyer does not have the opportunity to quickly collect the shipment, we recommend choosing delivery by courier or to indoor parcel lockers. The Buyer is responsible for the type of delivery he chooses at high or low temperatures. SIA BioWitel is not responsible for damagecausedbyfluctuationsinoutdoortemperatures.

8. Delivery and receipt of goods

   8.1. The delivery of the Goods is carried out to the address specified by the Buyer in the territory of the Republic of Latvia, which the Buyer must indicate before creating each order. 8.2. The delivery of the Goods is carried out only on business days. The Seller sends the Goods within the same business day, respectively, the Order is delivered within two to four business days. 8.3. The Seller has the right, by informing the Buyer in advance, to change the delivery time of the Goods. 8.4. A delivery fee is payable for the delivery of the Goods. The delivery fee depends on the selected delivery method. 8.5. If you choose to receive the Order at one of the self-service parcel lockers, on the day of delivery of the Order, the Buyer will receive an informative text message from the courier service, which contains the code for opening the parcel locker door.
    8.6. If you choose to receive the Order by Courier to the address specified by the Buyer, the Courier will contact the Buyer on the day of delivery of the Goods to inform the Buyer about the delivery time of the Goods. 8.7. At the time of delivery of the Goods by courier, the Buyer must present an identity document (passport or ID card to identify the Buyer. 8.8. If the delivery of the Goods to the Buyer is not possible due to circumstances dependent on the Buyer (the Buyer has specified an incorrect address and/or mobile phone number, the Buyer is not available at the specified address, it is impossible to contact the Buyer, the specified address cannot be accessed, etc.), the Goods are not sent again (except for cases when the Buyer has agreed with the Courier, before the Courier arrives at the specified address, about a second repeated delivery the next day without changing the original delivery address), but the purchase of the Goods may be canceled. In such a case, the Seller contacts the Buyer to find a solution: 8.8.1. The Seller cancels the order by refunding the price paid for the Goods, but does not refund the price of delivery of the Goods. 8.8.2. The Seller makes a repeated delivery. An additional fee is charged for repeated delivery. 8.9. Delivery of the Goods During the delivery, the Buyer is obliged to verify the conformity of the delivered Goods with the Order. 8.10. If damage or non-conformity with the Order is detected, the Buyer must immediately inform the Seller. If the delivery is made by a Courier, the Courier must also be informed of the non-conformity.

 9. Right of withdrawal. Exchange and return of goods

   9.1. In accordance with the Cabinet of Ministers' Regulations No. 255 "Regulations on Distance Contracts", the Buyer - a natural person may exercise the right of withdrawal and unilaterally withdraw from the contract within 14 calendar days from the date of delivery of the Goods. The Buyer cannot exercise the right of withdrawal if: Goods are delivered that cannot be returned by their nature, or they are perishable, are quickly consumed, if food or beverages are purchased, as well as if the purchased goods from the website have been opened and used. 9.2. The Buyer is responsible for ensuring that the value, quality and safety of the Goods do not decrease. Otherwise, the Seller has the right to refuse the Buyer the right of withdrawal in relation to the delivered Goods. 9.3. In order to exercise the right of withdrawal, the Buyer mustfillinthe www.biowitel.com availableWithdrawalform, indicatingthe data requested in the form. The withdrawal form must be submitted: 9.3.1. electronically to biowitelcontact@gmail.com  9.3.2. by post, by courier or in person to the Seller's office in Latvia: Riga, Matīsa iela 61 - 23, LV-1009. 9.4. The Product must also be submitted together with the completed Withdrawal Form. 9.5. In the event of exercising the right of withdrawal, the costs of returning the Product to theonline store www.biowitel.com isundertakenbytheBuyer. 9.6. The Buyer is entitled to exercise the right of withdrawal for all Goods purchased in one Purchase – upon receipt of the paid amount of the Goods price and the Delivery price refund or for a part of the Goods purchased in one purchase upon receipt of the paid Goods price refund for the Goods in respect of which the Buyer has exercised the right of withdrawal. 9.7. Promotional Goods are returned and the money is refunded in accordance with the promotional price of the Goods for which they were purchased. 9.8. The Seller has the right not to accept the Goods and refuse the Buyer to exercise the right of withdrawal, as well as not to refund the money paid by the Buyer for the Goods, if at the time of returning the Goods, damage to the Goods has been detected (removed and/or damaged labels, torn protective films, etc.) and/or signs of use of the Goods have been detected. 9.9. The refund of the paid price of the Goods in cases where the Buyer exercises the right of withdrawal is carried out within the terms and in accordance with the procedure established by the applicable laws and regulations. 9.10. Money for returned, undelivered or poor-quality goods will be transferred to your bank account from which you paid for the purchases, no later than 14 business days from the moment of submitting the complaint. If you made the payment in cash, you must indicate your bank account number.

10. Seller's rights and obligations

   10.1. The Seller undertakes to provide the Service in accordance with the requirements of applicable laws and regulations, in a high quality manner, observing the standards, criteria and ethical norms set for the profession of the Service Provider. 10.2. The Seller has the right to involve its own personnel or use subcontractors in the provision of the Service.
    10.3. The Seller undertakes to perform the Agreement and deliver the Goods to the Buyer in accordance with the terms of the Agreement and in the package specified in the Orders. 10.4. The Seller cannot guarantee that the delivery of the Order will be error-free. 10.5. If the Seller cannot fulfill any of the performance conditions included in the Terms (term, volume, quality, etc.), it shall promptly inform the Buyer by contacting the specified telephone number or e-mail, indicating the reasons and offering to make amendments to the terms of the Order or the Terms. The solution is found in accordance with the situation by agreement of both parties.

All disagreements and disputes that may arise between the Parties during the performance of the Agreement shall be resolved through mutual negotiations. If an agreement is not reached through negotiations, the disputes shall be considered in the courts of the Republic of Latvia.
